ESIC in 2026

ESIC is the health and social insurance side of statutory compliance. The 2026 headline is stability: the ESIC wage ceiling and contribution rates did not change, even as the PF ceiling rose. That creates a new band of employees, and a new source of confusion.

1. Who is covered

  • Establishments covered under the ESI Act, generally those with 10 or more employees (state notifications can differ).
  • Employees whose monthly wages do not exceed ₹21,000, or ₹25,000 for persons with disabilities.
  • Contract, casual, temporary and outsourced workers at a covered establishment may also be covered.

2. Contribution rates

Party Rate
Employer 3.25%
Employee 0.75%
Total 4.00%

The Central Rules round contributions up to the next rupee.

Worked examples

Gross wages Employee 0.75% Employer 3.25% Total
₹21,000 ₹157.50 ₹682.50 ₹840.00
₹15,000 ₹112.50 ₹487.50 ₹600.00

Applying the rounding rule, ₹157.50 becomes ₹158 and ₹682.50 becomes ₹683.

3. What counts as wages

Included: basic, DA, HRA, city compensatory allowance, attendance and night shift allowances, fixed monthly incentives, other regular allowances.

Excluded: annual bonus, ex-gratia, leave encashment, gratuity, retrenchment compensation, employer PF contribution, travel or business reimbursements.

Overtime is ignored when testing the ceiling, but contribution is deducted on overtime actually paid.

4. Contribution periods and benefit periods

Contribution period Benefit period
April – September January – June
October – March July – December

If an employee's salary rises above the ceiling mid-period, contributions generally continue until the current contribution period ends.

5. Benefits employees receive

Medical care, sickness benefit, extended sickness benefit, maternity benefit, temporary and permanent disablement benefit, dependants' benefit and funeral expenses. These are the reasons accurate registration matters: a missing IP number means a denied claim.

6. The ₹21,000–₹25,000 gap

After 17 September 2026:

Wage band PF ESIC
Up to ₹15,000 Covered Covered
₹15,001–₹21,000 Covered (newly) Covered
₹21,001–₹25,000 Covered (newly) Not covered
Above ₹25,000 Optional above ceiling Not covered

Employees in the third band pay PF but not ESIC. Employees whose pay is just under ₹21,000 will lose ESIC coverage when a hike pushes them across, so tell them in advance, especially if they have a family medical need.

7. Deadlines

  • Contribution: the ESI General Regulations allow up to the 21st of the following month, while most compliance calendars use the 15th as the due date. I recommend paying by the 15th to stay clear of interest [verify the cutoff your ESIC branch applies].
  • Registration: register the employer and each employee from day one. Delay can leave a new joiner uncovered during a claim.
  • Half-yearly returns: around 11 May and 11 November are quoted in one source [verify whether your branch still requires them].

8. Risks and trends

No major rule changes were notified for 2026 in the sources I reviewed. Expect closer review of contract-worker coverage, stricter registration checks and digital audits, and the SPREE enrolment scheme for legacy non-registration (one source says the SPREE amnesty closed on 31 January 2026 [verify]).

9. ESIC checklist

  1. Test every employee against ₹21,000 at the start of each contribution period.
  2. Register every new joiner as an IP from day one.
  3. Review contractor and outsourced staff coverage.
  4. Reconcile payroll to the ESIC challan monthly.
  5. Keep proof of payment and registration.
  6. Communicate coverage changes when pay crosses the ceiling.

The rates are fixed, but your headcount around the ceiling is not. A simple monthly band report prevents both over-deduction and uncovered claims.
